Sprint Visitor's Agreement
Effective March 1, 2017
This agreement (the "Agreement") is a contract between you and the individual, business, or organization ("Provider") currently providing you access to this wireless high-speed Internet ("Wi-Fi"). By clicking "Accept," or by using the Wi-Fi, you are acknowledging that you are at least 13 years of age, have read, understand, and agree to be bound by this Agreement. The effective date of this Agreement is the date on which you accept these Wi-Fi terms and conditions or access the Wi-Fi. You may accept this Agreement at the beginning of each session or by a one-time acceptance, in which case this Agreement, as amended from time to time, shall apply in full every time you access the Wi-Fi, whether or not you are required to subsequently indicate acceptance of this Agreement.
Provider will offer internet access (but not voice over Wi-Fi access) via the Wi-Fi at your current location ("Location"). If you choose to use other services while using the Wi-Fi, your use will also be governed by the terms and conditions provided to you in association with those services.
Provider reserves the right to monitor and collect information while you are connected to the Wi-Fi and to use the collected information at Provider's discretion, including sharing the information with any law enforcement agencies, Provider's partners and/or partner's vendors. You acknowledge that you may receive or be exposed to content, goods or services which you consider to be improper, inaccurate, misleading, defamatory, obscene or otherwise offensive. You agree that Provider is not liable for any action or inaction with respect to any such content accessible through the Wi-Fi. Provider collects information that you provide when you utilize Wi-Fi services. This information may include, but is not limited to, your name, email address, and mobile phone number. Provider also may collect information about your use of the Wi-Fi, such as the type of device you are using, version of operating system and signal strength, as well as information about how you use the device and services available through it, such as your location, web sites you have visited, applications downloaded or used, and all other data passed through the Wi-Fi network. We may link information we automatically collect with personal information, such as information you may provide when you accept these Terms. We may use systems or tools to follow your use of the Wi-Fi and other applications, including using cookies, web beacons and other mechanisms, along with analysis of network and device information. For example, we allow collection by analytic service provider(s) of site click-stream and cookie data to help us track aggregate and individual use of the Wi-Fi. Advertisers and advertising networks that serve ads on our sites may also use their own mechanisms, including cookies or we may share the information we collect about your use of the Wi-Fi for purposes of targeting ads to you. These third party cookies or tools are governed by the privacy policies of the entities placing the ads and are not subject to this Policy. Provider uses the information it collects for purposes such as to improve its services, conduct analytics and for targeted advertising and marketing purposes. Provider will only share personally identifiable information it collects from you with unaffiliated third parties with your permission or as required by law.
Third Party Sites
You agree to be responsible for and to bear all risk and consequences for (1) the accuracy, completeness, reliability and/or usefulness of any content available through the Wi-Fi and (2) all communications via the Wi-Fi. Provider does not exercise control over the sites you may visit and other services you may use while using the Wi-Fi. Other sites and services may place their own cookies or other files on your device, collect data, or solicit personal information from you. You should read the privacy policies of these sites and services to learn how they handle your personal information. Provider does not protect or guarantee the security of any data you send through the Wi-Fi, and it is your responsibility to secure your data. The Wi-Fi is provided on an "as is", "as available" basis with no guarantee or representation that it will be available at all times at the Location.
No Misuse of the Wi-Fi
You may not use the Wi-Fi for inappropriate or illegal activities. Some examples of inappropriate activities include (a) modifying, adapting, translating, or reverse engineering any portion of the Wi-Fi; (b) reselling any aspect of the Wi-Fi; (c) attempting to break security, access, tamper with or use any unauthorized areas of the Wi-Fi; (d) removing any copyright, trademark or other proprietary rights notices contained in or on the Wi-Fi; (e) attempting to collect or maintain any information about other users of the Wi-Fi or other third parties for unauthorized purposes; (f) logging onto the Wi-Fi under false or fraudulent pretenses; (g) creating or transmitting unwanted electronic communications such as "spam," or chain letters to other users or otherwise interfering with other user's enjoyment of the service; (h) transmitting content that infringes, misappropriates or violates the intellectual property, publicity, privacy or other proprietary rights of any party, or that is defamatory, unlawful or promotes or encourages illegal activity; (i) transmitting any viruses, worms, defects, Trojan horses or other items of a destructive nature on the Wi-Fi; or (j) using the Wi-Fi for any unlawful, harassing, abusive, criminal or fraudulent purpose.
We reserve the right to monitor, intercept and disclose any transmissions over or using our facilities, and to provide user information, or use records, and other related information under certain circumstances (for example, in response to lawful process, orders, subpoenas, or warrants, or to protect our rights, users or property). We also reserve the right to immediately and without notice, suspend your access to the Wi-Fi if we suspect that you are transmitting a virus (or any other manipulating program capable of modifying other programs and replicating itself). Access to the Wi-Fi may be blocked, suspended, or terminated at any time for any reason including, but not limited to, violation of this Agreement, actions that may lead to liability for Provider, disruption of access to other users or networks, and violation of applicable laws or regulations.
This Agreement May Change
Provider may, at its sole discretion, modify the terms and conditions of this Agreement. Such modifications shall be binding and effective upon posting on the Welcome page. By continuing to use the Wi-Fi after such postings, you accept and agree to any and all such modifications.
You agree to defend, indemnify and hold Provider and its corporate affiliates and officers, directors, stockholders, employees, agents, successors and assigns harmless from and against, and to promptly reimburse them for, any and all losses, claims, damages, settlements, costs, and liabilities of any nature whatsoever (including reasonable attorneys' fees) to which any of them may become subject arising out of, based upon, as a result of, or in any way connected with, your use of the Services or any breach of this Agreement.
PROVIDER MAKES AND YOU RECEIVE NO WARRANTY EXPRESS OR IMPLIED IN CONNECTION WITH THE SERVICES, AND ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY EXCLUDED. PROVIDER SHALL HAVE NO LIABILITY WITH RESPECT TO ITS OBLIGATIONS UNDER THIS AGREEMENT FOR CONSEQUENTIAL, EXEMPLARY, OR INCIDENTAL DAMAGES, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Limitation of Liability
PROVIDER'S LIABILITY TO YOU UNDER THIS AGREEMENT, AND YOUR EXCLUSIVE REMEDY FOR ANY LOSS, DAMAGE OR INJURY, REGARDLESS OF THE NATURE THEREOF AND SPECIFICALLY INCLUDING INDEMNITY, BREACH OF CONTRACT, NEGLIGENCE, TORT, AND WARRANTY CLAIMS SHALL NOT EXCEED, AND SHALL BE LIMITED TO, $100.
This Agreement constitutes the entire agreement between you and Provider with respect to the Wi-Fi. This Agreement shall be construed under the laws of the United States and the State of Kansas as applicable without giving effect to the principles of conflicts of law thereof. All disputes relating to this Agreement or the Services shall be brought in Johnson County, Kansas in a trial for which the right to a jury is hereby waived by both parties.
